University of Kentucky Law Professor Consulted in Major Newsday Housing Investigation

University of Kentucky J. David Rosenberg College of Law Professor Emeritus Robert Schwemm was one of two nationally recognized housing experts consulted during a three-year Newsday investigation of housing practices on Long Island. Newsday is the daily newspaper covering the Long Island area of New York City. The story, titled “Long Island Divided,” was published Nov. 17, 2019, and was accompanied by a 40-minute documentary. Using a technique called paired testing, Newsday found widespread evidence of unequal treatment by real estate agents on Long Island.

An excerpt from the article, titled “Nazi Past of Long Island Hamlet Persists in a Rule for Home Buyers,” is below: Robert G. Schwemm, a lawyer who teaches at the University of Kentucky, said enforcement of these kinds of covenants remained an issue, especially in closed communities where few know how homes change hands and where residents want things to remain the same.

Schwemm, Ashland-Spears Distinguished Research Professor at the University of Kentucky College of Law, has led to the adoption of final regulations by the Department of Housing and Urban Development (HUD) endorsing use of the “discriminatory effect” standard under the federal Fair Housing Act.
